Terms of Service

Welcome to BitSoul3D ("we," "our," or "us") — the trading name of BitSoul3D Studio, an independent business operated by Steve. By accessing or using our website (bitsoulhosting.com) and our 3D model marketplace, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Account Registration and Subscriptions

1.1 Account Creation: You must create an account to use the free monthly downloads. Single-model and bundle purchases may be completed as a guest with just an email address. You are responsible for maintaining the confidentiality of your account credentials.

1.2 Subscriptions: We offer Free, Indie, Pro, and Studio membership tiers. Paid subscriptions are billed monthly or annually via PayPal or card.

1.3 Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing cycle. You will retain access to your tier's benefits until the cycle ends.

1.4 Refunds: Due to the digital nature of our 3D models, all sales and subscription payments are final and non-refundable. For buyers in the EU/UK: because digital content is delivered immediately after payment, you expressly consent to immediate performance and acknowledge that you thereby waive the 14-day right of withdrawal for digital content; this is also stated at checkout before you pay.

1.4a Fault guarantee: If a purchased file is corrupt, will not open, or is not the model shown on its product page, tell us within 30 days of purchase and we will replace it or refund that purchase. This is the one exception to 1.4; it does not cover change of mind. Details: fault guarantee.

2. Licensing and Usage Rights

2.1 Ownership: All models on BitSoul3D are our proprietary content, licensed to you under the terms below. They are not released under Creative Commons, CC-BY, or any other open license, and they are never offered as “free for commercial use”.

2.2 Free accounts — personal use only: The two downloads included each month with a free account are licensed for personal projects, prototyping, and evaluation only. They carry no commercial rights. You may not use them in any product, game, client work, or other project that is sold, monetised, or distributed commercially.

2.3 Commercial use requires payment: Commercial rights are granted in three ways:

• An active paid membership (Indie, Pro, or Studio). Models you download while your subscription is active carry a worldwide, non-exclusive, royalty-free commercial license, and that license for those files survives cancellation.
• A single-model purchase (from $4.99). That specific model carries the same commercial license, permanently.
• An asset bundle purchase. Every model in a bundle you have bought carries the same worldwide, non-exclusive, royalty-free commercial license, permanently, with no membership required. Bundles are a one-time payment, not a subscription.

Studio members may additionally download a PDF Commercial License Certificate for their records.

2.4 Restrictions: Under every tier, including paid ones, you may not:

• Resell, redistribute, or sub-license the models as standalone assets, or include them in a competing asset pack or marketplace.
• Claim ownership or authorship of the models.
• Use the models to train machine learning or AI generation systems.

2.5 Changes to licensing: If we change these license terms, the change applies to downloads made after the change. It does not retroactively alter the license that applied to files you had already downloaded.

2.6 AI provenance: Models in the BitSoul3D catalogue are produced with the BitSoul3D generation engine and reviewed before listing. They are licensed to you under the BitSoul Standard License; no third-party artist attribution is required. Copyright treatment of AI-produced works varies by jurisdiction; where statutory copyright is unavailable, your license rights under these Terms apply unchanged.

3. Download Limits and API Access

3.1 Quotas: Monthly download limits (2 for Free, 25 for Indie, 100 for Pro, unlimited for Studio) reset on the first of each month. Unused downloads do not roll over.

3.2 API Access: Studio members are granted API access. You agree not to abuse the API, bypass rate limits, or use the API to scrape the entire catalog.

4. Acceptable Use, Automated Access and Our Content

4.1 What is ours: The 3D models, preview files, renders, images, text, page designs and code on this site belong to BitSoul3D Studio. A 3D preview exists so you can inspect a model on this site before buying it. A preview is not a purchase and carries no license of any kind.

4.2 No harvesting: You may not use bots, scrapers, scripts, headless or automated browsers, or any other automated means to copy, download or extract models, preview files, renders, images, text or page designs from this site, and you may not take a preview file out of the viewer by any means. Search engines and AI assistants may read our public pages in order to link to or cite them, as set out in our robots.txt. That permission covers pages only and never model or preview files.

4.3 No AI training or datasets: Content obtained from this site other than under a purchased license may not be used to train, fine-tune, evaluate or benchmark machine-learning or AI systems, or to build datasets, without our written permission.

4.4 No circumvention: Previews are delivered through technical protection measures (one-use tickets, encryption in transit, rate and network limits). You may not bypass, disable or interfere with them, probe the site for weaknesses, or disrupt the service for others.

4.5 What we do about it: We monitor for automated access, and we may slow, block or permanently refuse any address or network, close accounts, and send takedown notices (including under the DMCA) to anyone hosting or selling our content without a license. Files we deliver may carry an identifier that lets us trace where a leaked copy came from.

5. Limitation of Liability

Our 3D models are provided "as is" without warranties of any kind. We do not guarantee that the models will be error-free or compatible with every version of Unity, Unreal Engine, Godot, or other software. In no event shall BitSoul3D be liable for any indirect, incidental, or consequential damages arising from your use of our assets.

6. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or an announcement on the site. Continued use of the site after changes constitutes acceptance of the new terms.
